Will Smith Won An Early Court Battle After A Sexual Harassment Case Was Dismissed
Meanwhile, Will also scored a legal victory last month after a judge dismissed a sexual harassment lawsuit filed by former touring violinist Brian King Joseph.
Joseph alleged that an incident at a Las Vegas hotel in 2025 created a hostile work environment. According to court filings, he claimed that someone entered his hotel room without permission and left a handwritten note along with several personal items, including wipes, beer, and HIV medication.
He alleged the incident was connected to Will and later sued for sexual harassment and wrongful termination after claiming he was removed from his position for reporting his concerns.
However, the court ruled that the allegations, as presented, did not meet the legal standard required for a sexual harassment claim. The judge found that the complaint “fails to adequately allege conduct that is sufficiently severe or pervasive.”
The ruling also noted that Joseph had not established that Will or members of his management team were the only people who could have accessed the hotel room, citing circumstances suggesting others may have had access to the room key during the relevant period.
As a result, the lawsuit was dismissed. However, Joseph was granted permission to amend and refile his complaint if he is able to address the deficiencies identified by the court.
