Bailey Zimmerman is no longer facing criminal charges stemming from an alleged hotel room rampage in New Mexico after prosecutors officially dropped the case. According to the Bernalillo County District Attorney’s Office, the country singer’s felony and misdemeanor charges were dismissed after he paid full restitution to the Sandia Resort & Casino, where authorities alleged he caused thousands of dollars in damage ahead of a canceled concert. The resolution comes weeks after Bailey Zimmerman publicly apologized and accepted responsibility for his actions.
Zimmerman had been facing one felony count of criminal damage to property over $1,000 and one misdemeanor count of falsely obtaining services. According to the Bernalillo County District Attorney’s Office, prosecutors dismissed both charges after the singer fully reimbursed the resort for the damage.
Zimmerman’s attorney said the singer “immediately took responsibility for his mistake” and that his willingness to make restitution helped quickly resolve the matter. The dismissal marks the end of the criminal case that first made headlines in May.
Authorities Alleged Zimmerman Was Intoxicated Before Canceling Concert
According to the arrest affidavit, the incident began before Zimmerman ever returned to his hotel room. Authorities alleged the country star appeared intoxicated during soundcheck at Sandia Resort & Casino, where he had been scheduled to perform later that evening. Investigators claimed Zimmerman stumbled onto the stage before grabbing a guitar and striking it against the ground.
The affidavit also alleges he threw a microphone, walked off stage multiple times, kicked drum cymbals after returning, and shoved one of his guitarists as members of his band attempted to calm the situation. After leaving the stage, authorities further alleged Zimmerman spat toward a Sandia security officer after taking a drink of water.
Resort staff ultimately determined that Zimmerman and members of his team needed to leave the property because of his behavior, according to investigators.
Hotel Room Was Allegedly Left With $16,000 In Damage
Following the canceled concert, investigators alleged Zimmerman returned to his hotel room, where authorities say extensive property damage occurred. According to court documents, hotel staff discovered approximately $16,000 worth of damage inside the room the following day. Investigators alleged the damage included broken furniture, damaged electronics, holes in the walls, stained carpeting, and other destruction throughout the room.
Authorities also claimed Zimmerman left without paying more than $400 in alcohol charges that had been billed to the room. The allegations ultimately led prosecutors to pursue both felony property damage and misdemeanor theft-of-services charges before the case was later resolved.
Zimmerman Publicly Accepted Responsibility
Shortly after the allegations became public, Zimmerman released a lengthy statement apologizing to both the resort and his fans.
“I want to address the events surrounding my canceled show in New Mexico in May and the reports that have followed,” he began. “First things first, I want to apologize to the Pueblo of Sandia and to everyone at Sandia Resort & Casino. I never meant for any of this to come across as disrespectful. I am deeply sorry for my actions that transpired.”
He continued, “I respect your community and the hospitality and appreciate the opportunity that was given to me to perform on Native Land. I take full accountability for everything that happened and I am sorry to anyone who feels hurt or disrespected.”
Zimmerman also apologized directly to concertgoers. “To my fans who bought tickets and showed up expecting a performance, I am so sorry, you deserved better from me,” he said. “I understand that being a musician comes with big responsibilities, both on and off stage, and I know that I fell short that day. I am reflecting on the disappointment and concern that I caused.”
He concluded by promising to learn from the incident. “I am taking this legal matter seriously,” Zimmerman said. “I am committed to doing the work necessary to learn and grow. Thank you to my fans for holding me accountable and for understanding that I am human. I do not take your support for granted.”
Zimmerman’s legal troubles came during what has otherwise been a meteoric rise in country music. The Illinois native first gained national attention after posting videos of himself singing original songs on TikTok, where his authentic storytelling and powerful vocals quickly attracted millions of views. His breakout single, “Fall in Love,” became a massive hit and helped launch one of country music’s fastest-rising careers.
Zimmerman followed that success with his 2023 debut album, “Religiously. The Album.,” which produced multiple chart-topping singles and earned him a nomination for Best New Artist at the 2024 CMA Awards.
