‘Gross and disgusting conduct’
A third complainant told the court that Stronach had invited her to a midtown Toronto apartment, and while there he bent her over the arm of a chair, lifted up her skirt and tried to rape her. Stronach had been charged with attempt rape and indecent assault related to these allegations, but the Crown withdrew the attempted rape charge.
Molloy says she believed Stronach did come up behind the woman without warning, pushed her over a chair, raised her skirt and grinded into her vaginal area over her panties.
Still, she agreed with the Crown’s decision to withdraw the attempted rape charge because it was unclear the state of dress of Stronach and the complainant or whether it would have been possible for him to penetrate her through her panties.
But Molloy said it was clear by the evidence that there was no consent for Stronach’s contact with the complainant.
Molloy referred to it as “gross and disgusting conduct,” which is why she found him guilty of indecent assault.
